Broker Compliance

October 2020 (PM) — Question 3

How often must a broker file a written Status Report with Customs? In addition, which month must the report be received in order to be considered filed timely?

Why this answer

Under the edition tested, 19 CFR 111.30(d)(1) required each broker to file a written status report, with the prescribed fee, on February 1, 1985, and on February 1 of each third year after that date. The companion suspension rule bites only when the filing is not made by March 1 of the reporting year, so a report received during February is timely. Both elements of the keyed option follow: the frequency is every three years and the filing month is February. The distractors each get exactly one element right — pairing three years with January, or February with a two-year cycle — which is how this question is built to fool. Watch for: Pairing the right frequency with January, or the right month with a two-year cycle.
