April 2023 — Question 1

Which of the following forms or the electronic equivalent would NOT be created by the customs broker to be kept in the warehouse permit folder to support the original deposit of the merchandise in the bonded warehouse under Entry Type 21? The Port Director has not given permission for direct delivery.

Why this answer

Section 19.12(d) requires the warehouse proprietor's permit file folder to contain the documents evidencing the deposit of goods into the bonded warehouse, and for a type 21 entry without direct delivery those are the release and movement papers: the CBP Form 3461 release, the CBP Form 7501 warehouse entry, the CBP Form 6043 delivery ticket, and the CBP Form 7512 when the goods arrive in bond. The CBP Form 5106 merely establishes or updates the importer's identity account with CBP; it documents a party, not a deposit of merchandise, so it is the one form that does not belong in the folder. Watch for: Picking Form 3461 on the assumption warehouse entries never involve a release document.
