April 2023 — Question 4

Which of the following statements is TRUE? As indicated on the invoice, 10,000 kilograms of the cheddar cheese needs to be aged for six years. Cheese needs to remain in the same climate for the entirety of its aging process and the warehouse building has separate areas for bonded, foreign trade zone, and domestic merchandise.

Why this answer

Section 144.5 fixes the bonded warehousing period at five years from the date of importation, but its text adds that the Center director may permit a longer period upon a proper request and a showing of good cause. Filing that extension request before the fifth year expires, option A, is therefore the one lawful way to keep the cheese aging in place. The tempting workaround in option C fails because merchandise withdrawn for consumption is no longer bonded and cannot remain in the bonded area, and a rewarehouse entry under option E cannot restart the clock, which always runs from importation. Watch for: Believing five years cannot be extended, so constructing a withdrawal or rewarehouse workaround.
