October 2023 — Question 3
Calendar above provided for reference. On October 2, 2023, a broker pre-filed the entry and entry summary data creating a Type 01 consumption entry for a shipment. Upon arrival, the shipment cleared establishing the date of entry as October 3, 2023. Payment was scheduled for October 12, 2023, which is also the entry summary filing date. CBP rejected the entry on October 12, 2023. What is the last day on which revised entry summary information can be timely resubmitted?
- AOctober 14, 2023
- BOctober 16, 2023
- COctober 17, 2023
- DOctober 18, 2023✓ CBP's answer
Why this answer
Under the ACE entry summary process document tested, a rejected entry summary generally must be resubmitted within two working days of rejection, but a filer whose summary was submitted and rejected before the tenth day of the filing period keeps the remainder of that period: the ten working days measured from the date of entry. Entry occurred October 3, and counting ten working days while skipping weekends and the October 9 federal holiday reaches October 18, the keyed date. Option B applies only the two-day rejection rule, and option C counts ten working days but forgets to exclude the Columbus Day holiday. Watch for: Counting two business days from rejection instead of the remaining original filing period.
